Make your voice heard

Mental health tribunals

Mental health issues can affect anyone, at any time. Those affected can feel confused, lonely, and frightened, particularly if they have been detained for their own safety, or the safety of others. The Mental Health Tribunal is there to make sure everyone detained can have their case reviewed. It can be a daunting process, especially if you are not well.

If you need help making your voice heard, we can represent you at a Mental Health Tribunal Hearing. Beverley Bleasdale, our mental health specialist solicitor, has many years of experience in representing vulnerable people suffering from mental health problems. Beverley is accredited by the Law Society.

We can also advise on other legal problems relating to mental health issues, such as applications to hospital managers.

Mental Capacity Act

If your loved one cannot make decisions for themselves, the Mental Capacity Act 2005 sets out five principles to be applied, in order to ensure that any decision made on behalf of someone else is made in their best interests.

Taking important decisions on behalf of someone else can be very difficult. Input from doctors, social workers, and other professionals may be needed.

We can advise on all aspects of the law relating to the Mental Capacity Act and Deprivation of Liberty Safeguards, including “best interests” medical treatment decisions.

Funding your legal expenses

If you are a detained patient, you are entitled to free non means tested legal advice.

Means tested legal aid is available for advice on other legal problems involving mental health issues such as applications to hospital managers.

Legal aid is available to challenge Deprivation of Liberty Authorisations and some welfare cases in the Court of Protection, but not financial applications.
